Please read these Terms of Use carefully before using BabyJoy. BabyJoy is made by The Everest Lab.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms of Use:

  • Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to The Everest Lab, Singapore.

  • Country refers to: Singapore

  • Application refers to BabyJoy, the mobile app for parents and caregivers provided by the Company on iPhone and, where available, Android.

  • Service refers to the Website and/or the Application.

  • Website refers to the BabyJoy website, accessible from https://babyjoy.app

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

Acknowledgment

These are the Terms of Use governing the use of this Service and the agreement that operates between You and the Company. These Terms set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms. If You disagree with any part of these Terms then You may not access the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.

Health Information

BabyJoy provides general information only and is not medical advice. It does not diagnose or treat any condition and is not a substitute for professional medical advice, diagnosis or treatment. Food, allergen and safety content is based on published guidance from sources such as the AAP, NHS, WHO, CDC and ASCIA. Always talk to your pediatrician or healthcare provider about your baby’s health and diet, and never disregard professional advice or delay seeking it because of something you have read in BabyJoy.

In an emergency, call your local emergency number (995 Singapore · 911 US · 999 UK · 112 EU).

Subscriptions

BabyJoy is free to use. Optional Premium is sold through the App Store or Google Play and is billed, renewed and cancelled through your Apple ID or Google account under that store’s terms. On iPhone, Apple’s standard Licensed Application End User License Agreement also applies.

Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service in any way that violates any applicable national or international law or regulation.

Family sharing and acceptable use

When you share a baby with family members or caregivers, invite only people you trust and use sharing only to care for that baby. Do not add anything that is unlawful, abusive, hateful or sexual, that could harm a child, or that you do not have the right to share (including photos of other people’s children). The person who added a baby can remove any family member at any time, and anyone can leave a family. To report misuse, use “Report a problem” in Family sharing or email support@babyjoy.app. We review every report, may suspend or delete accounts that break these rules, and report content that puts a child at risk to the authorities.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of the Company. The Service is protected by copyright, trademark, and other laws of Singapore and foreign countries.

Our Service may contain links to third-party websites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms.

Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of these Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

”AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice.

Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Governing Law

The laws of Singapore, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Changes to These Terms

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
